The City and County of Denver recently announced significant updates to the Energize Denver Building Performance Policy, aiming to better support building owners while advancing the city’s climate goals. Below are the key highlights shared by Denver’s Office of Climate Action, Sustainability, and Resiliency:


Policy Enhancements

The city is working on updates to the rules and regulations for buildings 25,000 square feet and larger, addressing some of the challenges faced by building owners. Proposed updates include:

  • HVAC Flexibility: Allowing owners to align HVAC replacements with the end of the system’s service life.
  • Target Reduction Cap: Limiting required reductions to a maximum of 42%, benefiting one-third of buildings while maintaining climate targets.
  • Vacancy and Financial Stress Options: Alternative compliance pathways for buildings facing economic challenges.
  • Lease Adjustments: Flexible timelines for buildings impacted by lease terminations.
  • Adaptive Reuse Targets: Adjusting 2030 targets for projects preserving existing structures.
  • Penalty Adjustments: Revised penalty rate schedules to provide additional time for lower-penalty submissions.
  • Technical Guidance: Expanded resources for clearer compliance pathways.

Expanded Services

1-on-1 Building Consultations
Building owners can schedule a consultation with the Help Desk to review benchmarking data, assess Energy Use Intensity (EUI) targets, and explore compliance options.

Free Access to Basic Energy Management Portal
The free energy management portal, Touchstone IQ, provides insights into energy usage, project planning tools, and a virtual energy assessment.


Rebates for Energy Projects

Starting in 2025, Denver will offer $20 million in rebates for ASHRAE Level 2 energy audits and efficiency upgrades, adding to the $28 million in electrification rebates currently available. Rebates apply to projects initiated after October 1, 2024.


Equity Priority Building Support

The Compliance Assistance Program for Equity Priority Buildings has expanded to include:

  • Energy assessments and ASHRAE Level 2 Audits
  • Project implementation and contractor support
  • Guidance on financial incentives

These services aim to help buildings in vulnerable communities reduce costs and meet energy targets.


Updates for Manufacturing, Agricultural, and Industrial Buildings

The MAI Alternate Compliance Option application deadline has been extended to March 1, 2025, allowing more time for building owners to adjust to the proposed rule updates.
